राजस्थान सरकारी कर्मचारी को PSU / Autonomous Body / Corporation / Board में deputation या foreign service पर भेजने पर lien, pay, pension contribution, leave salary liability, permanent absorption और Service Book entry की practical guide.

महत्वपूर्ण नोट: यह लेख Government Employee → PSU / Autonomous Body direction के लिए है। यह PSU / Autonomous Body employee → Government direct recruitment pay protection वाला case नहीं है। दोनों situations अलग हैं।
Quick Answer: यदि राजस्थान सरकार का employee PSU / Autonomous Body / Corporation / Board में temporary transfer पर जाता है तो वह सामान्यतः deputation / foreign service case होगा। ऐसे case में deputation order, lien, pay terms, pension contribution, leave salary / leave encashment liability, Service Book entry और reversion date carefully record करनी होगी। यदि employee final absorption / permanent transfer / direct recruitment से PSU में चला जाता है, तो वह deputation नहीं रहेगा और अलग absorption / lien / resignation / retirement / Appendix IX / pension rules verify होंगे।
सबसे बड़ी सावधानी: Deputation और absorption को mix न करें। Deputation temporary arrangement है; final absorption / permanent transfer / direct recruitment अलग legal event है। गलत classification से lien, pension, leave, pay और Service Book में बड़ी गलती हो सकती है।

Government Employee to PSU / Autonomous Body case क्या है?

जब राजस्थान सरकार का कोई employee अपने parent Government Department से किसी Public Sector Undertaking, Government Company, Corporation, Board, Autonomous Body, University, Municipality या Government controlled body में temporary basis पर भेजा जाता है, तो यह सामान्यतः deputation / foreign service का case होता है।

RSR में foreign service का अर्थ केवल विदेश जाना नहीं है। Service rules की भाषा में Government establishment से बाहर किसी foreign employer / borrowing organisation में service करना भी foreign service हो सकता है। इसलिए PSU / Autonomous Body में temporary transfer को foreign service / deputation framework में examine किया जाता है।

Simple Meaning: Government employee temporarily PSU / Autonomous Body में जाता है तो deputation terms लागू होंगी। यदि वह permanently absorb हो जाता है या open recruitment/direct recruitment से PSU में जाता है, तो deputation terms automatically लागू नहीं होंगी।

Deputation / Foreign Service: कब admissible है?

Foreign service transfer तभी admissible माना जाएगा जब duties public reasons से Government servant द्वारा performed होने योग्य हों और employee transfer के समय Government-paid post hold करता हो या ऐसे post पर lien रखता हो। इसलिए हर deputation order में public interest, borrowing organisation, post, period और terms साफ होने चाहिए।

Consent Caution: सामान्य रूप से Government servant को foreign service में उसकी इच्छा के विरुद्ध transfer नहीं किया जा सकता, लेकिन Government owned/controlled body और Panchayat Samiti / Zila Parishad Fund जैसे cases में RSR exception भी देता है। इसलिए consent requirement को case-wise verify करें।
AG / Pension Authority Intimation: Foreign service sanction order की copy / intimation, charge transfer details, foreign service pay details, leave information और contribution-related information Accountant General / concerned pension-account authority को जहाँ applicable हो, समय पर भेजें। इससे pension contribution, leave salary liability और pension audit में delay नहीं होता।

Lien: Government post पर अधिकार कैसे रहेगा?

Substantive appointment to permanent post पर Government servant lien acquire करता है। RSR position के अनुसार, जब तक lien suspend या transfer नहीं होता, employee foreign service या temporary post / officiating post पर रहते हुए भी अपने substantive permanent post पर lien retain कर सकता है।

Lien Caution: Deputation order में यह साफ होना चाहिए कि employee का lien parent department में रहेगा या उसका suspension / transfer / termination किसी specific order से regulate होगा। Final absorption होने पर lien position अलग से decide करनी होगी।

Pay on Deputation: वेतन कौन देगा और कैसे regulate होगा?

Foreign service में Government servant foreign employer / borrowing organisation से pay draw करता है from the date he relinquishes charge of his Government post. Pay, joining time और joining time pay को sanctioning authority, foreign employer से consultation में regulate करती है। Current pay / deputation allowance / DA / HRA / special pay की exact terms latest Government orders और specific deputation order से verify करें।

Pension Contribution और Leave Salary: सबसे महत्वपूर्ण accounts point

Government servant का deputation / foreign service period pension और leave से जुड़ा है। Borrowing authority / foreign employer से pension contribution और leave salary / leave encashment liability का proper tracking जरूरी है। Delay होने पर pension case finalization में problem हो सकती है।

Final Absorption / Permanent Transfer: Deputation से अलग case

Deputation केवल temporary transfer को cover करती है। Final absorption, permanent appointment by transfer या direct recruitment in competition with open market candidates deputation में cover नहीं होते। इसलिए absorption पर अलग administrative / finance / pension action required होगा।

Absorption Caution: Final absorption order issue होने से पहले lien termination, resignation/retirement nature, pensionary benefits, leave encashment, GPF/NPS, seniority, pay on absorption and borrowing / absorbing organisation liability clearly decide करें। Local office अपने स्तर पर “deputation को absorption” न माने।
Appendix IX / Permanent Absorption Note: Permanent absorption deputation नहीं है। Absorption के बाद employee absorbing PSU / Autonomous Body के corresponding employees की तरह उसके rules से governed होगा। Pay absorption terms absorbing organisation से settle होंगे। Pension / family pension / leave encashment / GPF transfer / half-pay leave treatment / future Government pension liberalisation जैसे points को Appendix IX / Pension Rules और competent Government order के अनुसार decide करना चाहिए।

Reversion from Foreign Service: वापस Government में कब माना जाएगा?

Foreign service से reversion सामान्यतः उस date से माना जाएगा जिस date पर employee Government service में अपने post का charge लेता है। यदि foreign service समाप्ति के बाद Government में join करने से पहले leave ली जाती है, तो reversion date Government द्वारा decide की जा सकती है।

Reversion Entry: Relieving from PSU / borrowing body, joining in parent department, charge report, leave after foreign service और pay restoration सभी Service Book में clearly record करें।
